General Terms and Conditions (GTC)

1. Scope
These Terms and Conditions apply to all licenses purchased via motineo.com. By submitting a license request and completing payment, the customer agrees to these terms.

2. Subject of the Agreement
The customer acquires a non-exclusive synchronization license (sync license) to use the selected music track for film, web or motion picture usage. The track is delivered as a WAV file, accompanied by a signed license PDF.

3. License Scope
The license is valid worldwide, across all platforms, for a duration of one year. Commercial use is permitted. The license does not grant the right to sublicense, resell or claim authorship of the music.

4. Delivery
The customer will receive a personal download link (via Nextcloud) containing the WAV file and the signed license PDF. Delivery will only occur after payment has been received and the signed license agreement has been returned by the customer.

5. Prices and Payment
The introductory price for each track is €150. Payment is possible via PayPal or bank transfer. The license becomes valid upon confirmed payment.

6. Rights and Limitations
The customer may use the track in one project only. Any alteration, sampling, or redistribution of the music is prohibited without prior written consent. The composer remains the sole copyright holder.

7. GEMA Rights and Obligations
All works offered on motineo.com are registered with the German collecting society GEMA. The sync license purchased here covers the right to combine the music with visual media (synchronization).

The customer is responsible for ensuring that any public performance, broadcast, or online use complies with GEMA regulations.
For TV, radio, cinema or public screenings, additional reporting and possible fees may apply via GEMA or the relevant collecting society in the user’s country.
For online usage (e.g. YouTube, Vimeo, websites), GEMA claims are generally settled directly between the platform and GEMA.

These obligations are separate from the license agreement concluded with Motineo.

8. Liability
No liability is accepted for damages resulting from the use of the licensed track. The use is at the customer’s own risk.

9. Final Provisions
German law applies. Place of jurisdiction is Münster, Germany, unless otherwise mandated by consumer law.

Right of Withdrawal

1. Legal Right
Consumers within the EU have the right to withdraw from a contract within 14 days without giving any reason.

2. Digital Content Exception
The right of withdrawal expires prematurely if the performance of the contract has begun after the consumer:

has expressly consented to the seller starting the performance of the contract before the end of the withdrawal period, and
has acknowledged that by doing so, they lose their right of withdrawal.

3. Declaration
During the license request process, the customer explicitly agrees to the immediate execution of the contract and confirms that this waives their right of withdrawal.
